These Terms and Conditions (“Terms”) govern your use of the Galbi mobile application (“App”) provided by Zakaria Kerkeb (Sole Proprietor/Self‑Employed) (“we”, “us”, “our”). By using the App, you agree to these Terms.
- Use of the App
- Eligibility: You must be at least 16 years old and capable of forming a binding contract.
- License: We grant you a limited, non‑exclusive, non‑transferable, revocable license to use the App for personal, non‑commercial purposes in accordance with these Terms.
- Account Security: Keep your login credentials secure. You are responsible for all activities that occur under your account.
- Health and Safety Disclaimer
- The App supports general wellness, information, and self‑tracking. It is not a medical device and does not provide medical advice, diagnosis, or treatment.
- Always consult a qualified healthcare professional for medical concerns.
- Do not rely on the App for emergencies.
- Health Data and Permissions
- The App may request read access to Apple HealthKit for categories including heart rate, step count, exercise minutes, active/basal calories, walking/running distance, flights climbed, and stand minutes.
- You can review and revoke permissions at any time in the Apple Health app.
- HealthKit data is used only to provide in‑app functionality. We do not sell HealthKit data or use it for advertising.
- Subscriptions, Purchases, and Billing
- Certain features (e.g., premium insights such as “Rewind”) may require a paid subscription.
- Billing, free trials, renewals, and cancellations are handled by your platform provider (e.g., Apple App Store/Google Play) and/or Stripe (if used). Pricing and terms are shown in‑app.
- Manage/cancel your subscription via your platform account settings. Refunds follow your platform’s or Stripe’s policies.
- We may change offerings and pricing with notice as required by law and platform rules.
- Acceptable Use
- You will not: reverse engineer, attempt unauthorized access, interfere with App operation, infringe intellectual property, or violate applicable laws.
- Do not upload or transmit illegal, harmful, or infringing content.
- Intellectual Property
- The App, its content, features, and trademarks are owned by Zakaria Kerkeb or licensors and protected by law.
- You may not reproduce, modify, distribute, or create derivative works except as permitted by these Terms.
- Privacy
- Your use is subject to our Privacy Policy: https://galbi-app.com/privacy
- By using the App, you acknowledge our data practices described therein.
- Third‑Party Services
- The App integrates third‑party services (e.g., RevenueCat for subscriptions/paywalls, Stripe for payments where applicable, Sentry for crash reporting, Apple HealthKit for health data). Your use may be subject to their terms and policies.
- Disclaimer of Warranties
- The App is provided “as is” and “as available” without warranties of any kind, to the maximum extent permitted by law.
- We do not warrant that the App will be uninterrupted, secure, or error‑free, or that results will meet your requirements.
- Limitation of Liability
- To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the App and these Terms, whether in contract, tort (including negligence), or otherwise, will be limited to the greater of: (a) the amounts you actually paid for the Pro subscription to the App in the twelve (12) months immediately preceding the event giving rise to the liability (including amounts paid via the App Store), or (b) €50.
- Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by applicable law. Consumers may have mandatory statutory rights that are not affected by this clause.
- To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, data, goodwill, or business interruption, even if advised of the possibility of such damages.
- Indemnification
- You agree to defend, indemnify, and hold harmless Zakaria Kerkeb from and against any claims, liabilities, damages, losses, and expenses arising from your misuse of the App or violation of these Terms.
- Termination
- You may stop using the App at any time.
- We may suspend or terminate your access if you violate these Terms or for other lawful reasons.
- Upon termination, your license ends and you must cease use. Sections intended to survive (e.g., IP, disclaimers, limitations, governing law) will survive.
- Changes to the Terms
- We may modify these Terms. We will notify you of material changes in‑app or by email. Your continued use after changes become effective constitutes acceptance.
- Governing Law and Dispute Resolution
- Governing Law: These Terms (and any non‑contractual obligations arising out of or in connection with them) are governed by the laws of France, without regard to conflict‑of‑law principles.
- Venue & Jurisdiction: If you are a consumer domiciled in the EEA, the UK, or Switzerland, you may bring proceedings in the courts of your place of residence or in France; we will bring proceedings against you only in your local courts. If you are not a consumer (i.e., you use the App for business purposes), the courts of Paris, France have exclusive jurisdiction.
- Mandatory Consumer Rights: Nothing in these Terms affects your mandatory statutory rights under applicable consumer protection laws.

- Miscellaneous
- Entire Agreement: These Terms together with the Privacy Policy constitute the entire agreement between you and us regarding the App.
- Severability: If any provision is held unenforceable, the remaining provisions remain in full force and effect.
- Assignment: You may not assign these Terms without our prior written consent; we may assign as permitted by law.
- No Waiver: Our failure to enforce any provision is not a waiver of our right to do so later.
